The Fight between courts and legislature
Alabama recently had a fight over redistricting where the legislature enacted congressional districts; a district court overturned it reinstating the earlier districts; and the United States Supreme Court reinstated the legislature's districts. The District Court's reasoning had said that the legislative districts were racially gerrymandered. Using the rubric advocated here, the legislative districts are materially less gerrymandered. They are more compact and do not needlessly split the city of Mobile sending long tentacles into the corner of the state.
